Registration application for a Professional Solicitor, Fund-Raising Counsel, and Public Safety Solicitor

 

A professional solicitor, fund-raising counsel, or public safety solicitor must have applied to register appropriately with the Secretary of State in order to solicit charitable contributions in Maryland.


A professional solicitor must pay an annual registration fee of $350.

A fund-raising counsel must pay an annual registration fee of $250.

A public safety solicitor must pay a registration fee of $100 for each fund-raising contract it submits.

Review the steps - read carefully

  1. Complete the application form. You will select which type of registrant you are. That will determine the items needed to complete registration.
  2. A professional solicitor will need to have a surety bond in the amount of $25,000 to complete registration. It will also need to complete a fund-raising notice and submit a copy of a contract for each charitable organization for which it solicits in Maryland. For annual registrations, the professional solicitor is required to submit interim accounting reports for each of its contracts. When a contract ends, the professional solicitor is required to submit a final accounting report within 90 days of the contract’s expiration. If a professional solicitor enters into a new contract during the term of its registration, it must submit a fund-raising notice form to the Secretary of State before starting a public solicitation. A copy of the contract must accompany this form and must be submitted to the Secretary of State on or before the earlier of the tenth day after the agreement is made, or the start of a charitable solicitation.
  3. A fund-raising counsel will need to submit a copy of a contract for each charitable organization for which it solicits in Maryland. If a fund-raising counsel enters into a new contract during the term of its registration, it must submit a copy of a new contract to the Secretary of State on or before the earlier of the tenth day after the agreement is made, or the start of a charitable solicitation.
  4. A public safety solicitor will need to have a surety bond in the amount of $25,000 to complete registration. It will also need to submit a copy of a contract for each public safety organization for which it solicits in Maryland and pay $100 per contract.

What Happens After Submission

  1. The Charities & Legal Services Division will review the application and other documentation submitted. If the organization’s registration is complete, it will receive an email confirming it is registered. If the organization’s registration is incomplete or needs additional information, it will receive an email asking it to provide us stating the reasons the applicant is not in compliance.
